İndirici — Kullanım Koşulları ve Sorumluluk Reddi

Kısaca: İndirici'yi yalnızca hakkına sahip olduğun ya da indirme izni bulunan içerikler için kullan. Ne indirdiğinden ve indirdiğinle ne yaptığından yalnızca sen sorumlusun.

1. Bu koşulları kabul etmek

İndirici'yi indirerek, kurarak ya da kullanarak bu koşulları kabul etmiş olursun. Kabul etmiyorsan uygulamayı kullanma ve bilgisayarından sil.

2. Neyi indirebilirsin

İndirici'yi yalnızca şu içerikler için kullanabilirsin:

• kendi çektiğin ya da kendi yüklediğin içerikler,
• sahibinin indirmene açıkça izin verdiği içerikler,
• telif koruması sona ermiş ya da açık lisanslı (örneğin Creative Commons) içerikler; lisansın şartlarına uyarak.

3. Telif hakları

Başkasına ait videoları, müzikleri ve görselleri izinsiz indirmek, çoğaltmak, paylaşmak ya da yayınlamak 5846 sayılı Fikir ve Sanat Eserleri Kanunu (FSEK) kapsamında yasaktır; hukuki ve cezai sonuçları olabilir.

İndirdiğin bir içeriği nasıl kullanacağına sen karar verirsin. Bunun tüm hukuki, cezai ve mali sorumluluğu sana aittir. YouTube, TikTok ve Pinterest'in kendi kullanım koşulları da indirmeyi kısıtlayabilir; bu koşullara uymak da senin sorumluluğundadır.

4. Geliştiricinin sorumluluğu yoktur

İndirici bir araçtır. Geliştirici, kullanıcıların uygulamayla neyi indirdiğini görmez, denetlemez ve bundan sorumlu değildir.

Uygulamanın hukuka aykırı ya da bu koşullara aykırı kullanımından doğan hiçbir talepten, zarardan veya cezadan geliştirici sorumlu tutulamaz. Senin bu şekilde kullanman yüzünden geliştiriciye bir talep yöneltilirse, bundan doğan sorumluluk sana aittir.

5. Platformlarla bağlantı yoktur

İndirici; YouTube, Google, TikTok, ByteDance, Pinterest ya da başka herhangi bir platformla bağlantılı değildir. Bu şirketler tarafından onaylanmamış, desteklenmemiş veya ortak yapılmamıştır.

Bu adlar ve logolar sahiplerinin markasıdır. Uygulamada ve sitede yalnızca İndirici'nin hangi sitelerle çalıştığını anlatmak için kullanılır.

6. Garanti verilmez ("olduğu gibi")

İndirici ücretsizdir ve "olduğu gibi" sunulur. Çalışacağına, hatasız olacağına, platformlar değiştikçe çalışmaya devam edeceğine ya da belirli bir amaca uygun olduğuna dair hiçbir garanti verilmez.

Uygulamanın kullanımından doğabilecek veri kaybı, cihaz sorunu ya da başka bir zarardan, yürürlükteki hukukun izin verdiği en geniş ölçüde geliştirici sorumlu değildir. Geliştiricinin uygulamayı güncelleme ya da destek verme yükümlülüğü yoktur.

7. Kişisel veriler (KVKK)

İndirici senin bilgisayarında çalışır. Hesap açman istenmez. Adın, e-posta adresin, indirdiğin içerikler ya da indirme geçmişin geliştiriciye gönderilmez; geliştirici bunları toplamaz ve saklamaz. Kayıt klasörü ve bu koşulları kabul ettiğin bilgisi yalnızca kendi bilgisayarında tutulur.

Uygulama çalışırken yalnızca şu adreslere bağlanır:

• İndirmek istediğin içeriğin platformu (YouTube, TikTok, Pinterest): içerik doğrudan oradan iner.
• MusicBrainz (musicbrainz.org): YouTube'dan indirilen dosyaya şarkı adı, sanatçı ve kapak yazabilmek için parçanın adı sorulur.
• GitHub (github.com): ilk açılışta gerekli ffmpeg bileşeni buradan iner.
• indirici.mavrosai.site: yeni sürüm olup olmadığını öğrenmek için. Bu istekte senden hiçbir bilgi gönderilmez ve bu istekler için erişim kaydı tutulmaz.

Bu hizmetlerin kendi gizlilik politikaları geçerlidir. İndirme sayfası (indirici.mavrosai.site), her web sitesi gibi teknik sunucu kayıtları (IP adresi, tarih, istenen dosya) tutabilir; bu kayıtlar yalnızca sitenin çalışması ve güvenliği için kullanılır.

8. Açık kaynak

İndirici, açık kaynak YoutubeDownloader projesinden (MIT Lisansı) türetilmiştir ve başka açık kaynak bileşenler kullanır. Bu bileşenlerin lisansları uygulamayla birlikte gelen "Lisanslar" dosyasında ve https://indirici.mavrosai.site/lisanslar adresindedir.

9. Değişiklikler ve uygulanacak hukuk

Bu koşullar güncellenebilir. Güncel hali https://indirici.mavrosai.site/kosullar adresindedir; önemli bir değişiklikte uygulama yeniden onay ister. Bu koşullara Türkiye Cumhuriyeti hukuku uygulanır.

In short: Use İndirici only for content you own or have permission to download. You alone are responsible for what you download and what you do with it.

1. Accepting these terms

By downloading, installing or using İndirici you accept these terms. If you do not accept them, do not use the app and delete it from your computer.

2. What you may download

You may use İndirici only for:

• content you recorded or uploaded yourself,
• content whose owner has explicitly allowed you to download it,
• content that is in the public domain or openly licensed (for example Creative Commons), following the terms of that license.

3. Copyright

Downloading, copying, sharing or publishing other people's videos, music or images without permission is prohibited under Turkish Law No. 5846 on Intellectual and Artistic Works (FSEK) and may have civil and criminal consequences.

You decide how you use anything you download, and you bear all legal, criminal and financial responsibility for it. The terms of service of YouTube, TikTok and Pinterest may also restrict downloading; complying with them is your responsibility too.

4. No responsibility of the developer

İndirici is a tool. The developer does not see, monitor or control what users download with it and is not responsible for it.

The developer cannot be held liable for any claim, damage or penalty arising from unlawful use of the app or use that breaks these terms. If such use by you leads to a claim against the developer, the responsibility for it is yours.

5. No affiliation with any platform

İndirici is not affiliated with, endorsed by, sponsored by or partnered with YouTube, Google, TikTok, ByteDance, Pinterest or any other platform.

These names and logos are trademarks of their owners and are used only to describe which sites İndirici works with.

6. No warranty ("as is")

İndirici is free and provided "as is", without any warranty that it will work, be free of errors, keep working as platforms change, or be fit for a particular purpose.

To the fullest extent permitted by applicable law, the developer is not liable for data loss, device problems or any other damage arising from the use of the app. The developer has no obligation to update or support the app.

7. Personal data

İndirici runs on your computer. No account is required. Your name, email address, downloaded content and download history are not sent to the developer; the developer does not collect or store them. Your save folder and your acceptance of these terms are stored only on your own computer.

While running, the app connects only to:

• the platform of the content you want to download (YouTube, TikTok, Pinterest), from which the content is downloaded directly;
• MusicBrainz (musicbrainz.org), queried with the track name so that title, artist and cover art can be written into files downloaded from YouTube;
• GitHub (github.com), from which the required ffmpeg component is downloaded on first launch;
• indirici.mavrosai.site, to check for a new version. No information about you is sent in this request and no access log is kept for it.

The privacy policies of those services apply. Like any website, the download page (indirici.mavrosai.site) may keep technical server logs (IP address, date, requested file), used only to operate and secure the site.

8. Open source

İndirici is derived from the open-source YoutubeDownloader project (MIT License) and uses other open-source components. Their licenses are in the "Licenses" file shipped with the app and at https://indirici.mavrosai.site/lisanslar.

9. Changes and governing law

These terms may change. The current version is at https://indirici.mavrosai.site/kosullar; after a significant change the app asks for your acceptance again. These terms are governed by the laws of the Republic of Türkiye.
